These Terms of Service (“Terms”) govern your access to and use of our platform, applications, and services (collectively, the “Platform”) provided by MaiMovement (“we,” “us,” or “our”). 1. Eligibility

To use MaiMovement, you must:

• Be at least 18 years of age or the legal age in your jurisdiction.
• Create an account and agree to abide by these Terms.

2. Account Registration

You are responsible for maintaining the confidentiality of your login credentials and are solely responsible for all activities under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3. Platform Use and License

We grant you a limited, non-exclusive, non-transferable license to access and use our Platform for your organization’s sports data and video analysis needs. You may not:

• Reproduce, distribute, or publicly display any portion of the Platform without prior permission.
• Attempt to disrupt or compromise the Platform’s functionality or security.
• Use the Platform for unauthorized or illegal activities.

4. User Content and Data

Users may upload or create content, such as match data, video analyses, or XML files, on the Platform (collectively, “User Content”). By uploading User Content:

• You retain ownership of your content but grant us a license to store, display, and process it as needed for the Platform’s functionality.
• You represent that you have the necessary rights to use and share this content.

We are not liable for any loss or damage resulting from your use or disclosure of User Content. Sensitive data shared on the Platform should align with MaiMovement’s privacy guidelines and policies.

5. Intellectual Property Rights

All intellectual property rights, including copyrights, trademarks, and trade secrets related to the Platform, are owned by or licensed to us. You may not use our name, logo, or any trademarks without prior written permission.

6. Payment Terms

If MaiMovement services include any paid features:

• You agree to pay any applicable fees.
• Fees are non-refundable, unless otherwise required by law or expressly stated.

7. Data and Privacy

Your use of the Platform is governed by our Privacy Policy. By using the Platform, you consent to the collection, processing, and sharing of your information as described in our Privacy Policy.

8. Termination

We reserve the right to terminate or suspend your account and access to the Platform without prior notice if you violate these Terms or engage in conduct harmful to the Platform, other users, or our interests.

9. Disclaimer of Warranties

The Platform is provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, about the Platform’s reliability, availability, or suitability for your needs.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to, fitness for a particular purpose, non-infringement, and merchantability.

10. Limitation of Liability

To the fullest extent permitted by law, MaiMovement, its affiliates, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform. Our total liability in any claim related to the Platform will not exceed the amount paid by you (if any) for accessing the Platform.

11. Indemnification

You agree to indemnify and hold MaiMovement, its affiliates, and agents harmless from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the Platform.
• Your breach of these Terms.
• Any User Content you submit, post, or share.

12. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page, and we will notify you of significant updates. Your continued use of the Platform following any changes to the Terms signifies your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to its conflict of law principles. By using the Platform, you agree that any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts in the Netherlands. If you reside outside of the Netherlands, you may also have rights under the laws of your jurisdiction, which we honor where required.
